GENERAL
CONDITIONS OF CONTRACTING AND USE OF PREMIUM LOCKERS LOCKERS
OBJECTIVE
These general conditions regulate the contracting of Premium Lockers lockers
(owned by INTERIOR SMILE S.L.) through the website www.premiumlockers.es (the “Website”) as well as their use. Likewise, these conditions
govern the contractual relationship between Interior Smile, S.L. (owner of the
Premium Lockers lockers) and the User who contracts the Premium Lockers locker
service. Hereinafter, Interior Smile, S.L. will be referred to interchangeably
as Interior Smile, S.L. or Premium Lockers.
THE
SERVICE
Premium Lockers offers its Users the possibility to rent any of its lockers for
periods of calendar days (within the hours offered by Premium Lockers).
Users can deposit their luggage and belongings in the Premium Lockers
facilities, inside the reserved locker(s), exclusively during the contracted
reservation period.
Once the contracting process is completed, Users will receive a reservation
confirmation code, which will allow them to know the assigned locker number,
the duration of the contracted reservation, as well as the access code or key
to the locker, under the terms indicated in the section related to access and
reservation.
What
types of lockers does Premium Lockers offer?
- Small lockers (S), measuring 30
cm (height) x 40 cm (width) x 50 cm (depth). “Beach Special”.
- Medium lockers (M), measuring
40 cm (height) x 50 cm (width) x 60 cm (depth).
- Large lockers (XL), measuring
50 cm (height) x 50 cm (width) x 60 cm (depth).
- Extra-large lockers (XXL),
measuring 90 cm (height) x 50 cm (width) x 60 cm (depth).
What can
a User put inside their locker?
Within the limits established in this document (see, Section Limits on locker
use), a User can deposit as many items as they want, within the specified
measurements, to avoid overloading the locker.
How can
a User know if there are available lockers at Premium Lockers?
Through the Website www.premiumlockers.es, the User can check the
availability of lockers for the desired days.
For how
long can a single locker be rented?
The User can contract the locker rental service for a time range, full days, or
multiple days.
When can
the User access the rented locker(s)?
The locker rental service will be accessible to the User 24 hours a day, any
day of the week. Therefore, any User who rents a locker can access it from the
start date and time of the reservation and must remove their belongings before
the end of the contracted reservation period, whether by hours or full days (in
this case, until 23:59 on the reserved day). After the contracted reservation
period, Premium Lockers is authorized to open the locker and remove the belongings.
Under no circumstances will Premium Lockers open any items or access their
contents.
It is the User’s responsibility to deposit their belongings properly packed and
not leave loose items.
Items removed will be stored at the facilities for 48 hours, during which they
can be claimed by the User, who will be notified via email and/or WhatsApp that
their belongings have been removed and stored for 48 hours.
After this period, belongings will be presumed abandoned for all purposes, and
Premium Lockers will not assume any responsibility for them and will be free to
dispose of them, with no right for the customer to claim against Premium
Lockers.
Once
items are inserted by the User, can they only access the locker to remove them?
No, the Premium Lockers service is a locker rental service. The User can access
the rented locker(s) as many times as needed during the rental period. If the
User forgets something or needs to access their locker during the day, they can
do so freely during the reserved period using the access code provided and
notified at the time of booking.
What is
the price the User must pay per locker type, hours or days?
The price per locker will be as indicated on the Website at the time of
contracting, and the User may benefit from current offers.
Prices listed on the Website include IGIC and refer to the rental of a locker
(by size) for hours or calendar days.
How are
the lockers used?
The lockers offered through Premium Lockers are fully automated. The User can
make a reservation via our Website www.premiumlockers.es by providing, in addition to their personal data, the number of
lockers they wish to rent, their size, and the reservation period. Once the
booking is completed, the User will receive a confirmation of their
reservation, including the locker number(s) reserved and their security key to
access the locker(s).
Therefore, the User will access their locker using the security code provided
by Premium Lockers at the time of booking.
What can
the User do if they experience any issue with the locker?
In case of a malfunction, lockout, or any other issue with the locker, the User
can contact Premium Lockers’ assistance service by calling +34 676 614 762 or
by sending a written message to info@premiumlockers.es.
Can the
User modify or cancel their reservation?
Yes, provided that such modification or cancellation is made at least 24 hours
before the start date of the reserved service.
To cancel a confirmed reservation, the User must contact Premium Lockers via
the following phone number +34 676 614 762 or by email at info@premiumlockers.es. Cancellations or refunds will not be accepted if requested less than
24 hours before the reservation start time.
If applicable, the refund will be processed within a maximum of 20 days from
the cancellation date, provided the User canceled at least 24 hours in advance.
Any breach of the obligations derived from these General Conditions by either
party will entitle the non-breaching party to terminate the reservation through
simple written communication to the breaching party. The consequences of early
termination due to breach will be:
- If the User breaches, the
reservation will be canceled, and their belongings may be removed if not
done within 2 hours of being requested; the User will not be entitled to a
refund. In case of damages to the establishment, facilities, or other
users’ property, the User will be liable for damages caused.
- If the Company breaches, it
commits to refund the amount paid online by the User for the reservation.
ACCESS
AND RESERVATION
Premium Lockers will make their best efforts to keep the Website operational
24/7 and to ensure, as reasonably possible, the security of the Website.
However, Premium Lockers is not responsible for any malfunction, temporary
interruption, or loss of content attributable to third parties or due to
unforeseen events, force majeure, or acts beyond its control.
Premium Lockers reserves the right to temporarily interrupt access to the
Website for maintenance purposes, aiming to minimize the duration and impact on
Users.
To contract
the rental of Premium Lockers, the following requirements must be met:
- Be at least 16 years old or
older.
- Fill out accurately and
truthfully the fields in the reservation form on the Website (including
name, surname, phone, email, reservation date, rental days, number and
size of lockers, and payment details).
- Accept these general conditions
of service and locker use.
- Accept the privacy policy of
INTERIOR SMILE S.L., as the owner of Premium Lockers.
Once the
process is completed, the User will receive a reservation confirmation via
email, indicating the assigned locker number(s), reserved days, and access
codes.
Premium Lockers reserves the right to limit, reassign, or cancel reservations
in case of mechanical, electrical failures, or general maintenance, without the
User being entitled to compensation.
If the User
detects any issue or malfunction when retrieving their belongings, they must
immediately inform Premium Lockers by calling +34 676 614 762. Premium Lockers
commits to resolving the issue promptly, and the User is responsible for
arriving in time to retrieve their belongings.
If the issue cannot be resolved, Premium Lockers will cover the cost of sending
the belongings to the address provided by the User, provided the User had to
travel without their belongings due to the malfunction. The User will not be
entitled to claim any other damages.
The User
guarantees that all data provided regarding their identity and the reservation
are truthful, accurate, and complete.
The
personal data provided will be used to manage the reservation and fulfill the
obligations arising from the locker service for both parties. Interior Smile,
S.L. is entitled to process the personal data provided during the contracting
process by the User, as it is necessary for the provision of the service. By
contracting, the User expressly consents to the processing of their personal
data under the terms detailed herein.
Furthermore,
Interior Smile S.L. will use the personal data of locker Users, particularly
their email address, to send them commercial communications via email regarding
the services offered by Interior Smile S.L. and its commercial promotions. If
the User does not wish to receive commercial communications from Interior Smile
S.L. via email, they must check the appropriate box during the contracting
process. Conversely, if the User agrees to receive commercial communications
via email, Interior Smile S.L. informs them that such consent may be revoked at
any time.
Additionally,
the User is informed that there are video surveillance cameras installed in the
Premium Lockers premises. These cameras are intended to monitor the condition
of the lockers at all times, as well as their use by Users or third parties
accessing the premises, in order to provide a better service by Interior Smile,
S.L. All Premium Lockers locations include appropriate signage regarding the
video-surveilled area, in accordance with the applicable data protection
regulations.
The User
may exercise their rights of access, objection, restriction, rectification, and
erasure of their data at any time by sending a written request, including
identification (with a copy of their ID/NIE or passport), to:
info@premiumlockers.es. If the User, at any point, believes that Interior
Smile, S.L. has violated applicable data protection regulations, they have the
right to lodge a complaint with the relevant Supervisory Authorities,
particularly with the Spanish Data Protection Agency.
Interior
Smile, S.L. does not carry out international data transfers nor make automated
decisions based on the information provided by the User.
Interior
Smile, S.L. will retain the User’s personal data for as long as necessary to
provide the service and for the period required to comply with its legal
obligations. Once this period has ended, the data will be deleted. However,
Premium Lockers will retain the data insofar as the User’s consent to receive
commercial communications by email has not been revoked, if such consent was
given.
USER
OBLIGATIONS. LOCKER USAGE LIMITATIONS
By
contracting the Premium Lockers rental service, the User specifically agrees,
without limitation, to:
- Use only the reserved lockers
and solely for the purpose of temporarily storing personal belongings in a
secure place.
- Not use or deposit luggage in
an unreserved locker without having made a reservation or confirming it is
the assigned locker via the reservation code.
- Check the size of their luggage
before making the reservation to avoid overloading the locker. No claims
or refund requests will be accepted if the luggage exceeds the locker’s
dimensions.
- Under no circumstances is it
permitted to overload the locker or deposit items outside the designated
and reserved locker space. Depositing luggage in an unreserved locker or
one not assigned through confirmation at booking is strictly prohibited.
- Use the lockers with due care.
Specifically, and without limitation, the User agrees not to overload the
locker and to ensure it is properly closed upon leaving the premises
(after inserting or removing items).
- Immediately notify Premium
Lockers of any malfunction or irregular situation regarding the lockers by
calling the following number: +34 676 614 762. For example, it is
considered irregular if the locker reserved by the User is occupied by
another user's belongings; in such case, the User must not remove those
belongings. Failure to comply with this section may result in a penalty of
up to €500.
- Not use the lockers for illegal
or unauthorized purposes. In particular, the User agrees not to store
items whose possession or trade is illegal (such as stolen goods, drugs,
pornographic or degrading materials, etc.).
- Ensure that all items are
properly packed before depositing them.
- Not deposit any item that
requires a license unless the User possesses said license or authorization
(e.g., firearms).
- Not insert into the lockers any
contaminating or dangerous materials (e.g., flammable items, hazardous
substances), nor any explosive or corrosive items.
- Not use the lockers to store
animals or any living being.
- Not insert food into the
lockers, unless it is sealed, spill-proof, and will not stain the locker
or cause any odors on the Premium Lockers premises.
- Not share their security code
with any third party, being fully responsible for any breach of this
obligation and its consequences.
- Not use the lockers to store
goods intended to be collected by a third party. The lockers must not be
used as a means of goods transfer between parties, as this is not
authorized by Interior Smile, S.L.
- Access and remain on the
premises solely to use the rented locker and only to perform a specific
action related to the deposited items. The User may not stay in the
facility longer than strictly necessary.
- Not eat or drink inside the
facility.
- Remove all deposited items
before the end of the rental period (both in terms of date and time).
- Leave the lockers in the same
condition as they were found, and specifically notify Premium Lockers at
info@premiumlockers.es of any incident encountered when using the lockers
or regarding their condition.
- Not take photographs or videos
inside Premium Lockers premises and, in particular, not photograph or
record any security mechanisms.
- The User shall not place any valuable
items in the lockers, such as cash, jewelry, electronic devices (tablets,
laptops, televisions, etc.), or any documents that may be required for
identification or travel (e.g., identification documents or tickets). To
this end, the User undertakes to take all necessary precautions and
measures to ensure that no travel-related documents or other valuables are
left in the locker.
Interior Smile, S.L. shall not, under any
circumstances, be held liable for the loss of flights, trains, or any other
travel tickets resulting from the deposit of such tickets or identification
documents in the locker(s). Interior Smile, S.L. shall also not be liable for
the loss of any item whose individual value exceeds €1,000. Therefore, the User
shall bear full responsibility for depositing any such documents or items of
significant value or necessity in the rented lockers, contrary to the provisions
of these General Terms and Conditions.
CONSEQUENCES AND USER LIABILITY IN CASE OF
BREACH OF OBLIGATIONS
The User shall hold Interior Smile S.L.
harmless from any damage arising from the User’s failure to comply with the
obligations set forth in this agreement.
Failure to comply with the rental period.
In particular, if the User fails to empty the rented locker(s) on or before the
rental expiration date, Premium Lockers S.L. shall be authorized to access the
lockers and remove the stored items, in order to release them for ordinary use
by other Interior Smile S.L. customers. In such a case, Interior Smile S.L.
will temporarily store the items and attempt to contact the User who failed to
meet the rental deadline to manage the return of the items (all associated costs
shall be fully borne by the User). If 48 hours pass without contact from or
with the User and the items cannot be returned, the items shall be considered
abandoned by the User for all legal purposes. In such a case, Interior Smile
S.L. will cease to store the items and may dispose of them as it deems
appropriate or convenient, depending on the nature of the goods.
For each day that passes from the rental
expiration without the locker(s) being emptied by the User, until the items are
returned to or collected by the User, a daily charge equivalent to the rental
price of the unemptied locker shall accrue. Additionally, a penalty of €150
shall be payable by the User to Interior Smile, S.L., without prejudice to
Interior Smile S.L.’s right to claim any additional damages suffered.
Unless the User personally collects the items,
Interior Smile S.L. will arrange shipment of the items to the User, subject to
prior payment of the service costs by the User. Specifically, the User shall
pay Interior Smile S.L. €25 per item for shipments within Spain and €50 per
item for shipments outside of Spain. Delivery shall be considered completed
once Interior Smile, S.L. hands over the items to the carrier, and Interior
Smile S.L. assumes no risk related to the transport of the items.
The return of items shall only take place after
Interior Smile S.L. has received full payment from the User for the amounts due
for the return service (based on the number of items and destination) as
outlined above. If 10 calendar days pass from the date Interior Smile S.L.
informs the User in writing of the amount due and no payment has been made, the
items shall be considered abandoned by the User for all legal purposes.
Interior Smile S.L. shall then proceed in accordance with the provisions
outlined above for abandoned goods.
Interior Smile S.L. reserves the right to
remove any item that does not comply with the locker usage regulations and
constitutes a prohibited item.
In such cases, Interior Smile S.L. is authorized to contact the police and
report the conduct, as well as to remove the prohibited items.
The User shall be responsible for the items
placed in the lockers.
In any case, the removal of prohibited items will incur a penalty of €150. This
penalty shall not exclude the User’s obligation to compensate Interior Smile
S.L. for any actual damages caused.
Damage to Lockers by Users
The User shall be fully responsible for any
damage or deterioration caused to the lockers due to improper or inappropriate
use.
The User shall also be liable for any damage or deterioration caused to the
lockers or to other people's luggage as a result of storing prohibited or
dangerous items, improperly packaged goods, or misuse of the lockers. In such
cases, the User must compensate Interior Smile S.L. for any physical damage
caused to the locker(s), the facilities, or goods stored in other lockers, as
well as for loss of profits.
In particular, and without limitation, the User
responsible for the damage shall pay Interior Smile S.L. a daily rental penalty
for each day the locker remains out of service, as well as the cost of repair
or replacement. The replacement cost is set at €1,500. These penalties are in
addition to any other damages caused.
Payment of Penalties
The penalties detailed in this section shall be
paid by the User using the same payment method used to contract the service, or via bank transfer to the
account indicated by Interior Smile S.L., if requested by the User. The User
expressly agrees that Interior Smile S.L. may charge the amounts established in
this section using the payment card or method used by the User at the time of
contracting the service.
OBLIGATIONS OF PREMIUM LOCKERS
Premium Lockers undertakes to keep the locker
service active and to make available to the User, during the contracted rental
period, the locker(s) rented by the User in proper working condition.
Additionally, Premium Lockers undertakes to
resolve any issues that may arise in the use of the lockers as quickly as
possible. In the event of an incident, in order to safeguard the deposited
items, Premium Lockers reserves the right to move the deposited goods to a
warehouse or another locker.
LIMITATION OF LIABILITY OF Interior Smile, S.L.
Interior Smile S.L. provides a locker rental
service and is not responsible for the safekeeping of items.
The User is solely responsible for the belongings placed in the rented lockers.
Under no circumstances shall Interior Smile, S.L. be held liable for any
thefts that may occur.
The liability of Interior Smile S.L. is limited
to the duration of the locker rental period. Therefore, Interior Smile S.L.
shall not, under any circumstances, be liable for any damage or loss to the
User's belongings that occurs outside the contracted rental period.
CLAIMS
If the User believes they have grounds for a
complaint, they may submit it by sending an email to the following address: info@premiumlockers.es
Interior Smile S.L. will attempt to resolve the issue and seek a satisfactory
solution for both parties.
If the User is not satisfied with the response
from Interior Smile S.L., they may file an official complaint with the Consumer
Authorities of the Community of Las Palmas de Gran Canaria.
APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions are governed
by Spanish law. The parties submit to the jurisdiction of the Spanish
courts to resolve any dispute that may arise in connection with this
Contract.
